Custom Bride


  1. The following Terms & Conditions will apply to all sales and/or services rendered by Custom Bride to the client.
  2. Unless the context indicates a contrary intention, the following terms shall have the following meanings ascribed to them:
    1. “Custom Bride” means Custom Bride.
    2. “The Client” means the party to whom are sold and/or services are rendered
    3. “Goods” means any items manufactured and/or supplied by Custom Bride to The Client for sale
    4. “Services” means all related services rendered by Custom Bride  for and on behalf of The Client and “work performed” shall have a similar meaning
    5. “The Parties” means Custom Bride and The Client collectively
    6. “Quotation” means the written quotation furnished by Custom Bride to The Client for goods and/or Services, the acceptance of which shall constitute a binding agreement between the Parties
    7. “Delivery” means delivery of Goods to the Client
    8. “Collection” means collection of Goods by The Client from Custom Bride
  3. The heading used in these terms and conditions are for convenience only and shall not affect the interpretation hereof.
  4. The masculine shall include the feminine gender, natural persons shall include corporate entities and the singular shall include the plural, and vice versa.
  5. Prices quoted are based on costs and supply prices current at the time of the Quotation and are subject to change without notice.
  6. All our quotations are valid for a period of 7 days from date of issue unless stated otherwise.
  7. All alterations to be made to Goods will be for The Client’s own account unless agreed upon otherwise and reduced to writing and signed by or on behalf of both The Parties.
  8. No amendment and/or alteration and/or variation and/or deletion and/or cancellation of a Quotation shall be of any force or effect unless reduced to writing and signed by or on behalf of both The Parties.
  9. At Custom Bride  we offer our clients an Exchange Policy should the goods ordered by the Client not be supplied correctly, not in working order or should there be a fault with the Client’s goods caused due to a direct result of Custom Bride's gross negligence or recklessness.
  10. The signatory to the Quotation warrants that he/she is duly authorised thereto on behalf of The Client and has the necessary authority to bind The Client accordingly.
  11. Upon acceptance by The Client of the Quotation for the Goods for sale, and unless stipulated otherwise in writing, 100% of the Quotation price shall be paid to Custom Bride.
  12. All payments due by The Client shall be made free of any deduction and shall not be withheld or deferred on account of any claim counter claim or set-off.
  13. Custom Bride reserves the right to suspend and/or cancel its performance in terms of this agreement where The Client has not performed its obligations in terms of this agreement.
  14. Ownership of the Goods purchased shall not pass to The Client until fully paid for by The Client.
  15. No Goods will be collected or delivered should The Client’s Quotation not be paid in full.
  16. Should The Client not be able to pay the outstanding balance of their Quotation within a period of 15 days after notification, the Goods will be resold to cover costs incurred and The Client will forfeit the amount they already paid unless agreed upon otherwise by both Parties and reduced to writing.
  17. Due to each dress being made individually, Custom Bride cannot guarantee the exact duplication of any dresses chosen by The Client for manufacture.
  18. Should The Client make any changes or alterations to a current design, thereby changing or altering the style, detail or material of a dress they order,  Custom Bride will not be held liable in any way if the client is not satisfied with the end product. No refunds will be made in this instance and our “Exchange Policy” will not cover this matter. Should The Client in a case like this refuse to pay the outstanding balance on their Quotation (should there be one), the dress will be resold to cover costs incurred and The Client will forfeit the amount they already paid.
  19. Should there be, for whatever reason, no available stock of embroidery or any other accessory chosen by the client (included but not limited to veils, tiaras, petticoats, jewellery, gloves, trains, jackets and any other related accessories), Custom Bride reserves the right, after informing the client, to affect such changes to the embroidery or any other accessories so as to substantially comply with The Client’s requirements and to issue in its place the same or similar embroidery or accessories.
  20. Risk and responsibility in, of and for the Goods shall pass to The Client on Delivery and/or Collection thereof.
  21. The Client will be deemed to have inspected the Goods on taking Delivery thereof. Without derogating from the provisions of these terms and conditions, unless The Client advises Custom Bride in writing within 24 hours of Delivery or Collection of the Goods of any defects in the Goods, the Goods shall be deemed to have been delivered by Custom Bride in good order and condition and The Client shall not thereafter be entitled to return the Goods and claim a reduction in the purchase price of the Goods, on the grounds that the Goods are defective.
  22. In the event of Custom Bride instructing their attorneys to institute any legal action against The Client, The Client shall be liable for all legal costs incurred by Custom Bride on the scale as between attorney and client.
  23. Custom Bride may, at its discretion, elect to institute action against The Client in any Magistrate’s Court having jurisdiction, notwithstanding that the amount claimed may exceed the jurisdiction of the Magistrate’s Court.
  24. The Client nominates as his/her chosen domicilium citandi et executandi for all purposes in terms hereof the physical address indicated on the Quotation.
  25. The Client hereby indemnifies Custom Bride and holds it harmless against all and any claims for any damages suffered by Custom Bride as a result of any act or omission by The Client and/or any third party.
  26. Whilst every care will be taken by Custom Bride to deliver the Goods and/or render the Services in a proper and workmanlike manner,  Custom Bride shall not be liable to The Client for any damages, whether direct, indirect or consequential, caused by any act or omission of Custom Bride, its members or staff or any persons under its supervision or control, unless such damages were caused as a direct result of  Custom Bride's gross negligence or recklessness. In such an event, Custom Bride’s liability shall be limited to The Client’s actual direct loss and shall exclude any consequential damages.
  27. Custom Bride shall not be liable to The Client for any damages and/or delays caused as a result of any act of force (vis major event) beyond its reasonable control. Such vis major event shall be sufficient excuse for any delay in or suspension of the performance of Custom Bride’s obligations. The Parties shall regularly communicate with each other in order to mitigate the adverse effects of a vis major event.
  28. No indulgence granted by Custom Bride to The Client shall be deemed to be a waiver or novation of any of the rights of Custom Bride in terms hereof.
  29. No Condition, term, warranty, representation or undertaking not contained in these terms shall be binding on Custom Bride, unless reduced to writing and signed by or on behalf of both Parties.
  30. Each term herein shall constitute a  separate and divisible term and is any such term becomes unenforceable for any reason whatsoever, that term shall be severable from the remainder hereof and shall not affect the validity of the remainder of the terms.
  31. These terms and conditions may be amended or added to by Custom Bride at any time, in its sole discretion.
  32. The client acknowledges that he/she has read and understood these terms and conditions and accepts them as binding.
